Terms and Conditions for Wolt & Live Nation Delivers

For any orders from Live Nation venues through the Wolt Service, Wolt’s User Terms of Service apply with the following changes and additions:
1. DEFINITIONS 1.1 In these Terms and Conditions, the following terms shall have the following meanings: “Wolt” means Wolt Enterprises Oy, which is responsible for the Wolt Service. “Wolt Service” means both Wolt App and Wolt website wolt.com through which Orders may be placed. “Order” means an instruction or purchase order for an Event to be delivered that is made by the User on the Wolt Service. “Event” means the appearance of an Artist at a predetermined time and location arranged by the User. “Artist” means a specified performer (s) that may be ordered for an Event. “User” means the person who has placed and paid for an Order and thus acts as the responsible organizer of the Event following the terms below. “Live Nation” means Live Nation Finland Oy, which sells private Events through the Wolt Service in a separately agreed outdoor space following the terms below. “Personal Data” means all personal data processed in connection with the Order, as mentioned in Section 7. Processing of Personal Data. 2. PLACING AN ORDER THROUGH THE WOLT SERVICE 2.1 When a User places an Order, they agree to these Terms and Conditions for Wolt & Live Nation Delivers. In conjunction with the additions and changes required by these Terms and Conditions, Orders are subject to the Wolt Terms of Use and Privacy Statement, which are available at: https://wolt.com/en/terms. The Terms for Wolt & Live Nation Delivers use the definitions set forth in the Wolt Terms of Use, when applicable. 2.2 The User places an Order for the Event in the Wolt Service in a similar way as any food or other order on Wolt. The person who places the order and completes a payment on Wolt Service is the User in accordance with these Terms and Conditions. 2.3 Live Nation is responsible for the production of the Events in its entirety, including the delivery of the Artist performing at the Event to the agreed location, the technical implementation of the Event, the security arrangements for the Event and the handling of any User complaints. 2.4 The delivery area of each Event is limited by city according to the information provided in the Wolt Service. The User determines the outdoor location of the Event according to the delivery area defined in the Wolt Service. The User is entitled to order an Event only for each area defined for the specific Event. If the User orders the Event outside the delivery area, Live Nation has no obligation to complete the Order or to reimburse for the cancelled Order. 3. PERSONS AND NUMBER OF PEOPLE PARTICIPATING IN THE EVENT 3.1 The User may invite other persons to participate in the Event, strictly in accordance with the restrictions and recommendations enforced by the Finnish government and the local Regional Government Agency related to COVID-19, that are applicable at the time of the Event, as well as any restrictions on gatherings. Subject to event restrictions, the number of persons allowed does not include the Artist or any accompanying technical staff. The Artist and other staff will supervise safety distances at the Event and will not be in physical contact with the persons participating in the Event. In this way, Live Nation can guarantee that the number of people attending is in accordance with the current official restrictions and guidelines. 3.2 If gathering restrictions or other COVID-19 related guidelines change prior to the Event, they must be followed by the User. However, the number of people attending the Event may in no circumstances exceed 10 people, excluding the Artist and any technical staff. 3.3 The User is also responsible for ensuring that other people participating in the Event only attend if healthy i.e., showing no signs of COVID-19 or other transmittable respiratory disease, have not tested positive for COVID-19 or have been told to quarantine or isolate. The User must have contact information of all Event attendees so that they can be contacted after the Event, if necessary. This data may be used to communicate important information about the event and/or transferred to local health authorities if needed, to track potential chains of disease transmission. 4. EVENT SECURITY AND SAFETY 4.1 The User is responsible for ensuring that the Event is safe to organize in accordance with these Terms and Conditions. The User must define an outdoor space suitable for the Event. An indoor space cannot be defined as the Event location. In addition, the Event must be organized outdoors so that the Artist and any instruments / technical equipment must have a cover / canopy in case of unsuitable weather conditions (e.g., rain). When placing an Order, the User must indicate the desired address for the Event in the comment field of the Order in the Wolt Service. 4.2 Live Nation and/or the Artist reserves the right to refuse to perform the Event in reasonable circumstances including without limitation (a) for health and safety or licensing reasons, (b) if the User or its guests behave in a dangerous or irresponsible manner, (c) if You use or display threatening, abusive or insulting words or mannerisms or behave in a manner which may provoke a breach of the peace, (d) if, in Live Nation’s reasonable opinion, the User or its guests appear to be acting under the influence of alcohol or drugs, (e) if the User or its guests breaches the Terms and Conditions. No refunds will be given in these circumstances. 4.3 The User must ensure that the guidelines and regulations relating to COVID-19 that are applicable at the time are complied with, including that the necessary safety distances can be supervised at the Event, face masks are available and worn by the persons attending and hand sanitizer and/or hand washing facilities are available. The User will also be responsible for taking reasonable steps in choosing the location of the Event to ensure that there are no outside distractions, number of participants allowed is not exceeded and no safety disturbances occur. Live Nation reserves the right to call the User before the Event to ensure that the conditions set out in this section are met. 4.4 Live Nation is responsible for the production of the Event incl. arrival of the Artist ordered for the Event at the agreed location and delivery and installation of the necessary equipment. It is the responsibility of Live Nation to ensure that the Event is conducted in the highest quality possible. 4.5 Live Nation is responsible for the security of the Artist present at the Event and the technical arrangements of the Event. If the number of people attending is in violation of these conditions at the time of the Event or the security of the Event cannot otherwise be guaranteed, Live Nation and/or Artist have the right to delay the start of the Event or cancel the Event completely without separate compensation or reimbursement to the User. 5. AUTOGRAPHS, SET LIST AND PHOTOGRAPHS 5.1 Due to the general COVID-19 status in Finland, autographs or personal photographs together with the Artist are not allowed. In most cases, taking photos of the Event and performance is allowed at the Artist’s discretion for personal use. Professional photography or videography is not permitted. The Artist reserves the right to deny any photography or videography at the Event. 5.2 For several Artists, the set list is predetermined, or the User must select the songs to be performed in advance when placing the Order. It is not possible to add any songs after the Order has been placed. 6. EVENT CANCELLATION 6.1 Orders sold on the Wolt Service comply with the general terms and conditions of the Wolt Service. By placing and paying for an Order, the User commits to purchasing the Order. The User does not have the right to cancel the Order (Chapter 6, Section 16, Item 11 of the Consumer Protection Act 38/1978). Live Nation or Wolt shall have no obligation to reimburse the Order except for the special cases set forth in this section. 6.2 If the User becomes ill, the parties will primarily work together to arrange a new time for the Event. If a new time is found and the payment has not yet been refunded, it can be postponed covering the price of the new Order. Alternatively, the payment for a cancelled Order can be refunded to the User and when the new time for the Event is confirmed, the User will repay the Order according to the original price. 6.3 If the parties state that a new date for the Order cannot be found within reason, the User has the right for a refund due to illness. Upon request, the user must verify the reason for the cancellation in accordance with Wolt's specific instructions. 6.4 A verifying statement of illness is required to receive a refund. The certificate of illness or other proof must be presented no later than 24 hours before the Event. If the certificate is presented less than 24 hours prior to the Event, Wolt and Live Nation will not be required to refund the price of the Order to the User. 6.5 If the Event is cancelled due to the Artist's illness or other compelling reason or for a reason outside the reasonable control of Live Nation or the Artist, the parties will first and foremost, work together to arrange a new time for the Event. If a new time is found and the payment has not yet been refunded; it can be postponed covering the price of the new Order. Alternatively, the payment for a cancelled Order can be refunded to the User and when the new time for the Event is confirmed, the User will repay the Order according to the original price. 6.6 If the parties state that a new date for the Order cannot be found within reason, the User has the right to receive a refund. The User will then receive a full refund. 6.7 If the COVID-19 status in the locational area of operations requires it, Live Nation reserves the right to postpone or cancel the Order due to force majeure. 7. PROCESSING OF PERSONAL DATA 7.1 To the extent that access to personal information is necessary to receive an Order and execute the Event, Wolt will distribute User Data to Live Nation for processing on Wolt's behalf. 7.2 When third parties process data on Wolt's behalf, Wolt has taken appropriate contractual and organizational measures to ensure that personal data is processed solely for the purposes set forth in Wolt's Privacy Policy and these Terms and in accordance with applicable laws, regulations and guidelines, subject to appropriate confidentiality. 7.3 Live Nation processes the following personal information of the Event User: - Name - Phone number - Address of the location - Other information provided by the User in connection with the Order 7.4 If the User cancels the ordered Event in accordance with section 6 of these Terms and Conditions, Wolt may process the information necessary to verify the refund of the payment based on instructions and information provided separately by Wolt. 8. COMPLAINTS AND DAMAGES 8.1 Live Nation commits to deliver the Event according to the Order placed by the User in the Wolt Service in accordance with the information provided at the time of ordering. If there are any errors in the delivery of the Order, the User may contact Live Nation. Live Nation can be contacted through the following contact information: info@livenation.fi. The User can also contact via the Wolt chat feature or by email at support@wolt.com. 8.2 Live Nation is solely responsible for any errors related to the content of the Order or Event or otherwise, the execution of these Terms and Conditions. 8.3 A User who feels a breach of the Terms and Conditions has occurred, should file a complaint with Live Nation or Wolt without delay. Errors must be clearly identified in the complaint. Live Nation is responsible for all refunds related to the Order and the Event, as well as for responding to User complaints. 8.4 Subject to applicable law, Live Nation's maximum liability shall always be limited to the price of the Order paid and Live Nation shall not be liable to the User for any other costs or wasted expenditure or loss of enjoyment incurred in connection with the organization or cancellation of the Event.
