Terms of Participation 1. Details of the Organiser. The limited liability company under the name "WOLT SERVICES CYPRUS LIMITED” and the distinctive sign “WOLT MARKET CYPRUS”., which has its registered office at Lampousas 1, Nicosia, 1095 Cyprus, with Tax Identification Number 10430832E, e-mail contact: marketing.cyprus@wolt.com , hereinafter referred to as the "Organiser", is organizing a competition on the internet, on its website www.wolt.com (hereinafter referred to as the "Competition"), in accordance with the following terms and conditions of participation, all of which are agreed to be material. 2. Name, Prize & Competition Duration Competition name: "Wolt Market X Christmas" Competition Prizes: 1 Sony PlayStation 5 Slim 2 Smartphone Xiaomi Redmi 12C 1 Xiaomi Mi Smart Air Fryer 1 Smartwatch Egoboo Pop Up M5 1 Xiaomi Robot Vacuum E10 4 vouchers worth 200€ each for Wolt Market Competition start date: 18/12/2023 Competition end date: 07/01/2024 3. Conditions of Participation Users wishing to participate in the Competition must place an online order from Wolt Market stores through the website of the Organizer www.wolt.com or through the corresponding mobile application of 35€ or above. Participation in the Competition requires acceptance of these terms and conditions, which should be expressed by writing the phrase "I accept the terms of the Contest and consent to the processing of my personal data" on the Promoter's website. 4. Eligible participants All users of the website www.wolt.com or the corresponding mobile application are eligible to participate in the Contest, provided that they reside in Cyprus, have reached the age of 18 and have full legal capacity. Excluded are persons incapable of legal capacity, employees of the Promoter and its affiliated or related companies, as well as the spouses of all the above persons and their relatives by blood or marriage up to the second degree in a straight or lateral line. Any participation of the above persons in the Competition in breach of this condition shall be automatically void. The Organiser may, at any stage of the Competition, require participants to produce identification and legal documents attesting to the validity of their participation in accordance with the above terms, in whole or in part. 5. Inadmissible applications Applications submitted by persons who are ineligible or prohibited from participating, as referred to in paragraph 1. 4, will not be taken into consideration and will in any case be excluded from the Competition, as soon as this is established by the Organiser. The Organiser may exclude from the competition at any stage any participant who does not comply with these conditions. Participation Procedure Users will participate in the Competition by making specific purchases through the website www.wolt.com or through the corresponding mobile application from Wolt Market stores during the period of the Competition. Each successfully completed purchase of 35€ or above through Wolt Market stores will correspond to one entry into the draw for the Prize. Users may make additional specific purchases of the above criteria from Wolt Market stores, thereby earning more entries into the Competition. Entry is strictly personal, it cannot be transferred or done through an agent. 6. Other conditions of participation (a) By participating in the Competition, which is conditional on full and unconditional acceptance of these terms and conditions, users are deemed to declare that they are at least 18 years of age and have full legal capacity. (b) Participation in the Competition requires that the interested parties have access to the Internet by their own technical means. The Organiser does not assume any obligation to provide, facilitate or assist access to Internet sites or to provide facilities to any interested party. Access to the Competition website is only permitted under the operating conditions of the server concerned and must comply with these conditions. 7. Draw Ten (10) winners will be selected through an electronic draw, which will be conducted, in the presence of a representative of the Organiser on 07/1/24, at Wolt, by random selection through a computer program, ensuring the randomness of the selection of the participants and the impossibility of human intervention in it (the “Chosen Participants”). The draw will also determine the 4 alternates in the event that the Chosen Participants cannot be found or do not respond to the prize question correctly, or otherwise refuse to accept the Prize upon winning. 8. Prize The Prize is personal, non-transferable, non-exchangeable, non-assignable, non- assignable to relatives or third parties, nor can it be requested to be replaced with another or modified by the winner or redeemed for cash. 9. Responsibility for the Prize The Organiser shall not be liable for any direct or indirect damages, costs and expenses that may arise from any legal or factual defects or lack of agreed qualities of the prize or from delays in its delivery or any other cause relating to the prize in question. Once the prize is delivered intact to the recipient and the recipient signs for the receipt of the prize, he/she cannot make any claim against the company in respect of the prize. 10. Draw Results Announcement A relevant email will be sent by the Organiser for the results of the draw to the declared email of the Winners, informing them accordingly and asking them to respond with their personal information (full name, address, floor & name at the doorbell, area, city, postal code & phone number) in order to receive the prize. Also, the Wolt support department will contact the winner through the chat service available in the app and attempt a phone call in case the winner does not respond to messages. If the respective winner does not confirm his/her interest in the Prize within 5 working days or his/her participation is cancelled, a corresponding email will be sent to the first alternate winner selected in order. The Organiser shall not be liable if any of the details provided by the Winner are incorrect or are not the personal email address and telephone number of the Winner and therefore the Winner is not notified of the Prize in time. 11. Method of delivery of the Prize The prize will be sent to the address indicated to the Organiser by the winner, at the Organizer’s expense. The prize will be collected by the winner upon presentation of his/her Identity Card or other public document showing his/her identity and age. 12. Responsibility of the Organiser i. The Organiser is not responsible if users have given false information about their age and participate in the Competition. ii. The Organiser is exempted from the obligation to deliver prizes in cases where the present terms of participation have not been complied with in any way. iii. The Organiser is not responsible in the event that for any technical reason it is temporarily impossible for the technical systems to process the competition, as well as to receive and record the data of the participants. In any case, the liability of the Organiser will be limited to acts or omissions due to fraud or gross negligence and will in no case extend to acts due to slight negligence, fortunate events or force majeure. iv. In the event that any of the above deadlines expire without action, the Prize will be forfeited and the Organiser may dispose or not dispose of the Prize at its discretion, having fulfilled its obligations to the elected alternate winners in accordance with the above. In particular, in the event that for any reason the Winner does not respond or does not comply with any of these terms and conditions, his/her right to receive the Prize shall be automatically forfeited. 13. Modification of terms / cancellation of the Competition The Organiser reserves the right, unilaterally, without prior notice and at its sole discretion, to modify, withdraw, extend or reduce the duration of the competition, to change the offered prize, as well as to change the terms and dates of participation and/or to cancel the competition, by announcing the fact on the website www.wolt.com. In such cases, the Promoter shall have no liability whatsoever towards the participants and/or any third party. In the event that such a competition may be cancelled, the participants - candidates do not acquire any right against the Promoter, nor are they entitled or entitled to request the continuation of the competition or any compensation. 14. Viewing - Intellectual Property Rights The Organiser reserves the right to advertise any event related to the Competition, such as the awarding of the Prize, etc. To this end, the winners, automatically by participating in the Competition, at the same time expressly and unconditionally consent to the use of their email for the purposes of this Competition, as well as the use of any audio recordings or radio recordings, television or online and generally public announcements of their name and their statements by the Organiser and allows the Organiser to use them for one (1) year from the receipt of their prize, without prior consultation with them, without requiring their further consent (as such, participation in this competition - draw) and without any financial or other claim or demand on their part. 15. Signals etc. Entrants do not have or acquire any rights whatsoever to the Organiser’s trademarks, names, indications, advertising slogans, emblems and other distinctive features. 16. Processing of Personal Data A. How personal data is used. The Organiser will process to the extent necessary the personal data made available to it by the participants in the competition for the purposes of conducting the draw, communicating with the participants and the winners before, during and after the competition, delivering the Prize to the winners, confirming the age and identity of the participants and the winners and their compliance with the terms of the competition, as well as for the publication of the winners in the ways and means described in the terms of the competition. Β. Categories of personal data to be processed by the Organiser. The Organiser will process the following personal data of the participants in the competition: Email, mobile phone, order history In addition to the above, the Promoter will process the following personal data of the winners: Address, identification details C. Persons who will have access to the personal data. Winners' personal data will be sent to a partner distribution company to the extent necessary for the delivery of the prize to them. D. Legal basis of the processing. The processing of personal data is based on the consent of the participants of the Contest, which is obtained at the time of purchase of products participating in the Competition. The terms and conditions are detailed on the Organiser’s website www.wolt.com or on the corresponding mobile application. The publication of the details of the winners and any promotional activities in the context of which personal data of the winners is processed have as a legal basis for processing the legitimate interest of the Organiser to promote its business through the Competition. E. Right to withdraw consent. Participants have the right to withdraw their consent to the processing of their personal data for the purposes of the Competition at any time by sending an e-mail to marketing.cyprus@wolt.com. In this case, the submitted entry form will automatically become invalid and if the withdrawal is made after a participant has been declared the winner, the declaration will be automatically revoked and the provisions of clause 14 will apply accordingly in respect of the Prize. The lawfulness of the processing based on consent prior to its revocation shall not be affected. F. Retention period of personal data. The personal data of the participants will be kept for 30 days from the receipt of the Prize by the winners or from the final cancellation of the competition. Winners' personal data will be retained for a period of 1 year from the declaration of the winners. G. Other rights. Participants also reserve the right of access, rectification, erasure, restriction of processing of their personal data, opposition to processing and portability which they can exercise by sending an e-mail to marketing.cyprus@wolt.com. Finally, they have the right to lodge a complaint with the Office of the Commissioner for Personal Data Protection located at1 Iasonos Street, 1082 Nicosia, Cyprus tel. 22818456, fax 22304565, e-mail commissioner dataprotection.gov.cy, if they consider that the processing of their personal data violates the applicable national and regulatory framework for the protection of personal data. 17. Express Declaration/Acceptance of Participants The Organiser reserves the right to use and publish any news item relevant to the conduct and results of the Competition. 18. Publicity The terms and conditions of participation in this Competition will be posted on the Organiser’s website www.wolt.com com or on the corresponding mobile application. For any information or complaint regarding the Competition, any participant or third party may send an email to marketing.cyprus@wolt.com 19. Acceptance of the Terms - Applicable Law - Jurisdiction By submitting an application to participate in the Competition, each participant declares that he/she has read and fully accepts the terms of participation. Participation in the Competition constitutes unconditional acceptance of all the terms and conditions set out herein and implies the consequent waiver of any relevant claim or demand against the Promoter, other than those arising from the published terms and conditions. This constitutes the entire agreement between the Organiser and the participant and shall not be binding on anyone other than the Organiser and the participant. No modification of these terms will be considered and will not form part of this agreement unless it is expressed in writing and incorporated herein. In any case, participants may refer to these Conditions in order to be informed of any amendments to them. Any dispute between the parties arising out of or in connection with this Competition shall be settled amicably between the Organiser and the participants in good faith and in accordance with good commercial practice. In any case, the courts of Cyprus are designated as competent for the resolution of any such dispute.
